Terms of Service

FaceData is operated by Digital Experience Corporation ("we", "us", "our").
These terms govern your use of FaceData, an identity-verification service operated by Digital Experience Corporation. By creating an account or using the service, you agree to them. If you do not agree, do not use FaceData.
1. Eligibility
You must be at least 18 years old to use FaceData. Accounts are for individual use — you may not share your account, and you may not create an account on someone else's behalf. We may refuse or close any account at our discretion.
2. What the service does
FaceData lets one person confirm that another person is the individual behind a verified FaceData profile. It works like this:
- You generate a short verification code from your dashboard, which places a hold on one credit.
- You give that code to the person you want to verify, however you are already talking to them.
- That person enters the code on our site. Unless they very recently passed the same check, they are sent to our verification provider's own hosted flow to complete a live face capture, which the provider compares against the identity it already holds for them. The result reaches us shortly afterwards rather than instantly.
- If the check passes, you are shown — and emailed — a confirmation that the person verified their identity.
What a successful verification does and does not tell you. A match indicates that the person who entered your code passed a face comparison against a profile whose identity documents were previously checked by our verification provider. It is a point-in-time technical check. It is not a guarantee of that person's character, intentions, safety, current circumstances, or of anything they tell you. Do not treat a verification as a substitute for your own judgment.
3. Your account
You are responsible for the accuracy of your account details, for keeping your password confidential, and for everything done through your account. We recommend enabling two-factor authentication, which is available to all users from your profile settings; administrator accounts are required to use it.
We may email you about your account, including verification outcomes and security notices. Some features require a confirmed email address.
4. Credits and payment
Verification is paid for with credits. Generating a code holds one credit; the hold is released if the code expires, if you revoke it, or if verification ultimately fails, and the credit is spent when a verification succeeds. Credits are an entitlement to use the service — they are not currency, are not transferable between accounts, and cannot be exchanged for cash.
Credits are sold in packages. Payment is processed by third-party billing providers, and their terms apply to the payment itself. We do not receive or store your full payment-instrument details; if you choose to save a card for faster checkout, we store only its brand and last four digits together with a reuse reference issued by the billing provider. Refunds are handled at our discretion; contact us if you believe a charge is incorrect.
Some packages are subscriptions. A subscription renews automatically at the price and interval stated on the package before you buy it, and keeps renewing until you cancel. You can cancel at any time from your billing page: future renewal charges stop, and credits you have already been granted remain yours to use. Cancelling does not refund charges already made.
Credit prices and package contents may change. Changes do not affect credits you have already purchased.
5. Verified profiles
If you are the person being verified, you may propose a public display name and choose whether your profile appears in our public directory. Both are reviewed by us before they go live, and every subsequent edit is reviewed again — your previously approved details stay live in the meantime. We may decline a proposed name, remove a profile from the directory, or withhold approval, and we do not guarantee that any profile will be listed.
You may only upload a photo of yourself, and only one you have the right to use. Your photo is used for face comparison, so it must clearly show your face.
6. Identity verification and biometric data
Identity verification is carried out by our verification provider, VerifyMy. When you verify your identity, you submit your identity document and a selfie or liveness capture directly to them, through their hosted flow. We receive the outcome, not the documents.
Face comparison (our "liveness check") involves biometric processing: our verification provider captures a live image of your face and compares it against the identity documents you already verified with them, to determine whether they are the same person. By verifying your identity and using verification, you consent to this biometric processing for the purpose of confirming your identity through FaceData. You can withdraw that consent at any time by contacting us, but doing so ends your ability to be verified through the service. 7. Acceptable use
You agree not to:
- impersonate anyone, or submit identity documents or photos that are not your own;
- attempt to verify a code you generated yourself, or otherwise fake a verification result;
- use automated means to generate or enter codes, or attempt to guess codes belonging to someone else;
- scrape, bulk-collect, or republish our public directory;
- use FaceData to harass, stalk, or coerce anyone, including pressuring someone into verifying against their will;
- interfere with the security or operation of the service, or attempt to access another user's account.
We rate-limit code entry and cap retries to protect against abuse. Breaking these rules may cost you access without a refund.
8. Deactivation, deletion and suspension
You may deactivate your account at any time from your profile settings. Deactivation is reversible and leaves your data intact: you can still sign in, but the rest of the service is unavailable until you explicitly reactivate. Nothing reactivates your account automatically.
You may also delete your account. Deleting releases your email address for reuse and ends your access, but we retain the underlying records for support, dispute-resolution and audit purposes rather than erasing them immediately. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we reasonably believe your use puts other users or the service at risk.
9. Disclaimers
FaceData is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or that any verification result is accurate in every case — verification depends on third-party providers and on the quality of the images involved. To the fullest extent permitted by law, we disclaim all implied warranties.
10. Limitation of liability
To the fullest extent permitted by law, Digital Experience Corporation is not liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on a verification result or from your dealings with any other person. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify Digital Experience Corporation against claims, losses and costs arising from your breach of these terms or your misuse of the service.
12. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and disputes are subject to the exclusive jurisdiction of the state and federal courts located in California. Contact us before starting formal proceedings — most issues can be resolved directly.
13. Changes to these terms
We may update these terms as the service develops. The "last updated" date above reflects the current version, and continued use of FaceData after a change means you accept the updated terms. If a change materially reduces your rights, we will make reasonable efforts to tell you.
